CAS publishes reasoning in Sion case

The Court of Arbitration for Sport has published the full reasoning for its verdict in the case UEFA v FC Sion, given on 14 December 2011 and following the hearing of 24 November.

The Court of Arbitration for Sport (CAS) has published the full reasoning for its verdict in the case UEFA v FC Sion, rendered on 14 December 2011 and following the hearing of 24 November 2011.

In the comprehensive 62-page document, the CAS explains the reasons behind its ruling, whereby the request filed by UEFA to confirm that OLA (Olympique des Alpes SA) was not entitled to be reintegrated in the 2011/12 UEFA Europa League was deemed admissible and upheld.

Among the reasons published, the CAS stated that it had jurisdiction to rule on the case, based on the entry form for the 2011/12 UEFA Europa League signed by the president of Sion, and acknowledging the CAS jurisdiction, as well as stipulations in the UEFA Statutes providing for exclusive CAS jurisdiction.

The CAS said it noted that UEFA must be in a position to ensure uniform application of its regulations at European level to guarantee equality between all clubs taking part in its competitions. It also concluded that UEFA, in deciding to disqualify Sion from the 2011/12 UEFA Europa League, did not commit an abuse of a dominant market position in light of the Swiss Cartel Act.
